Celem artykułu jest przedstawienie wybranych wątków związanych ze sprawowaniem przez Mikołaja Zebrzydowskiego urzędu starosty krakowskiego (1585–1620). Autor skoncentrował się na trzech kwestiach: objęciu starostwa, zaangażowaniu Zebrzydowskiego w sprawowanie wymiaru sprawiedliwości oraz wpływie rokoszu sandomierskiego (1606–1608) na działalność grodu krakowskiego. Główną podstawę źródłową tekstu stanowią krakowskie akta grodzkie, przechowywane w Archiwum Narodowym w Krakowie. Będąc studium przypadku, artykuł bada problem z perspektywy historycznoprawnej, krytycznie analizuje źródła oraz korzysta z metod statystycznych i porównawczych. Dzięki ich wykorzystaniu udało się odtworzyć przebieg czynności, które (...) doprowadziły do objęcia starostwa przez Zebrzydowskiego w 1585 r. Z zestawienia działalności Zebrzydowskiego z Janem Zamoyskim i Gabrielem Tarnowskim wynika, że jego zaangażowanie w sprawowanie wymiaru sprawiedliwości nie było duże, chociaż większe niż poprzednika i następcy. Limitując roki, Zebrzydowski chętnie powoływał się na sprawy prywatne, ale jego następca czynił to jeszcze częściej. Duży wpływ na funkcjonowanie starostwa miał rokosz sandomierski. Sąd nie działał przez ponad trzy i pół roku, urząd przez ponad 17 miesięcy, a kancelaria grodzka przez niecały rok. W sporze o położoną na Wawelu kamienicę starościńską, który stanowi symbol konfliktu Zebrzydowskiego z Zygmuntem III, rację należy przyznać królowi, pełnoprawnemu właścicielowi budynku, chociaż jego postępowanie w tej sprawie zaostrzało napięcie. Celem artykułu jest przedstawienie działalności publicznej marszałka wielkiego koronnego i starosty krakowskiego Mikołaja Zebrzydowskiego w czasie toczących się latem 1596 r. w Krakowie międzynarodowych pertraktacji w sprawie zawarcia pod egidą papiestwa antytureckiej Ligi Świętej. Do odtworzenia tego aspektu autor wykorzystał głównie rękopiśmienne materiały źródłowe pochodzące z archiwów rzymskich oraz źródła drukowane i odnośną literaturę przedmiotu. Mikołaj Zebrzydowski pojawił się w Krakowie 10 lipca 1596 r. w momencie, gdy już od prawie miesiąca przebywał w nim legat papieski, kardynał Enrico Caetani, który (...) miał przewodniczyć wspomnianym obradom. Zebrzydowski wielokrotnie spotykał się z kardynałem zarówno na oficjalnych obradach, jak również na stopie prywatnej. Kardynał informował o tych kontaktach Sekretariat Stanu, donosząc, iż Zebrzydowski jest jednym z tych polskich dostojników, który otwarcie pragnie wspierać inicjatywę Stolicy Apostolskiej. Jak się jednak wydaje, Mikołaj Zebrzydowski jako bliski współpracownik kanclerza Jana Zamoyskiego realistycznie oceniał te szanse, dostrzegając zagrożenie dla polityki papieskiej w twardym i nieprzychylnym Polsce stanowisku Habsburgów. Fenomenológia ducha, zdôrazňuje Heidegger, je prvou časťou Hegelom plánovaného systému vied. Jej podtitul znie: Veda o skúsenosti vedomia. Tou vedou (Wissenschaft) bude filozofia, chápaná ako veda o skúsenosti vedomia, teda o skúsenosti, ktorú má vedomie seba samého. Filozofii, podľa Hegela, ide o absolútne poznanie, teda o poznanie v najvšeobecnejšom zmysle slova. Možno teda tvrdiť, že kým Hegelovi išlo vo Fenomenológii ducha o vzťah človeka, poznávajúceho subjektu, schopného sebauvedomenia, k absolútnu, tak Heideggerovi v jeho interpretácii Hegelovej Fenomenológie ducha išlo predovšetkým (...) o absolútno samé, teda o bytie, ako ho chápal. Pre Heideggera nie je problematika obsiahnutá vo Fenomenológii ducha ničím iným ako artikuláciou protikladu: nekonečnosť bytia verzus konečnosť jestvujúcna. (shrink)

Ce que la postérité a retenu de Georg Wilhelm Friedrich Hegel tient en une formule simple et cependant énigmatique : Hegel aurait prétendu achever la métaphysique en instituant un "idéalisme absolu", qui ne serait autre que l'expression éhontée d'un subjectivisme sans limite. Or, dans son oeuvre publiée (pour ne rien dire de ses cours), Hegel consacre des développements très détaillés à l'objectivité et à la connaissance empirique. Cela est vrai de la Logique, de la Philosophie de la Nature et de (...) la Philosophie de l'Esprit. Il s'en suit une série de questions. Que signifie l'expression "objectivité de la pensée" chez Hegel? S'agit-il de l'objectivité visée par la pensée ou de la réalité objective de la pensée elle-même? Le génitif est-il objectif ou subjectif? Et s'il était à la fois l'un et l'autre? A partir de ces questions, il s'agit de comprendre l'idéalisme hégélien dans son rapport au monde et d'interroger son actualité. Theories of spatial cognition are derived from many sources. Psychologists are concerned with determining the features of the mind which, in combination with external inputs, produce our spatialized experience. A review of philosophical and other approaches has convinced us that the brain must come equipped to impose a three-dimensional Euclidean framework on experience – our analysis suggests that object re-identification may require such a framework. We identify this absolute, nonegocentric, spatial framework with a specific neural system centered in the hippocampus.A (...) consideration of the kinds of behaviours in which such a spatial mapping system would be important is followed by an analysis of the anatomy and physiology of this system, with special emphasis on the place-coded neurons recorded in the hippocampus of freely moving rats. A tentative physiological model for the hippocampal cognitive map is proposed. A review of lesion studies, in tasks as diverse as discrimination learning, avoidance, and extinction, shows that the cognitive map notion can adequately explain much of the data.The model is extended to humans by the assumption that spatial maps are built in one hemisphere, semantic maps in the other. The latter provide a semantic deep structure within which discourse comprehension and production can be achieved. Evidence from the study of amnesic patients, briefly reviewed, is consistent with this extension. (shrink)

Many accounts of informed consent in medical ethics claim that it is valuable because it supports individual autonomy. Unfortunately there are many distinct conceptions of individual autonomy, and their ethical importance varies. A better reason for taking informed consent seriously is that it provides assurance that patients and others are neither deceived nor coerced. Present debates about the relative importance of generic and specific consent do not address this issue squarely. Consent is a propositional attitude, so intransitive: complete, wholly specific (...) consent is an illusion. Since the point of consent procedures is to limit deception and coercion, they should be designed to give patients and others control over the amount of information they receive and opportunity to rescind consent already given. How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. The power of technology to transform religions, science, and political institutions has often been presented as nothing short of revolutionary. Does technology have a similarly transformative influence on societies’ morality? Scholars have not rigorously investigated the role of technology in moral revolutions, even though existing research on technomoral change suggests that this role may be considerable. In this paper, we explore what the role of technology in moral revolutions, understood as processes of radical group-level moral change, amounts to. We do (...) so by investigating four historical episodes of radical moral change in which technology plays a noteworthy role. Our case-studies illustrate the plurality of mechanisms involved in technomoral revolutions, but also suggest general patterns of technomoral change, such as technology’s capacity to stabilize and destabilize moral systems, and to make morally salient phenomena visible or invisible. We find several leads to expand and refine conceptual tools for analysing moral change, specifically by crystallizing the notions of ‘technomoral niche construction’ and ‘moral payoff mechanisms’. Coming to terms with the role of technology in radical moral change, we argue, enriches our understanding of moral revolutions, and alerts us to the depths of which technology can change our societies in wanted and unwanted ways. A contrast is often drawn between standard adult capacities for autonomy, which allow informed consent to be given or withheld, and patients' reduced capacities, which demand paternalistic treatment. But patients may not be radically different from the rest of us, in that all human capacities for autonomous action are limited. An adequate account of paternalism and the role that consent and respect for persons can play in medical and other practice has to be developed within an ethical theory that does (...) not impose an idealised picture of unlimited autonomy but allows for the variable and partial character of actual human autonomy. Kant's ethics, like others, has unavoidable anthropocentric starting points: only humans, or other 'rational natures', can hold obligations. Seemingly this should not make speciesist conclusions unavoidable: might not rational natures have obligations to the non-rational? However, Kant's argument for the unconditional value of rational natures cannot readily be extended to show that all non-human animals have unconditional value, or rights. Nevertheless Kant's speciesism is not thoroughgoing. He does not view non-rational animals as mere items for use. He allows for indirect (...) duties 'with regard to' them which afford welfare but not rights, and can allow for indirect duties 'with regard to' abstract and dispersed aspects of nature, such as biodiversity, species and habitats. The aim of the study was to determine the acceptance and perception of Nigerian patients to medical photography. A self-administered questionnaire was distributed among Nigerian patients attending oral and maxillofacial surgery and plastic surgery clinics of 3 tertiary health institutions. Information requested included patients' opinion about consent process, capturing equipment, distribution and accessibility of medical photographs. The use of non-identifiable medical photographs was more acceptable than identifiable to respondents for all purposes (P = 0.003). Most respondents were favourably disposed to (...) photographs being taken for inclusion in the case note, but opposed to identifiable photographs being used for other purposes most especially in medical websites and medical journals. Female respondents preferred non-identifiable medical photographs to identifiable ones (P = 0.001). Most respondents (78%) indicated that their consent be sought for each of the outline needs for medical photography. Half of the respondents indicated that identifiable photographs may have a negative effect on their persons; and the most commonly mentioned effects were social stigmatization, bad publicity and emotional/psychological effects. Most of the respondents preferred the use of hospital-owned camera to personal camera/personal camera-phone for their medical photographs. Most respondents (67.8%) indicated that they would like to be informed about the use of their photographs on every occasion, and 74% indicated that they would like to be informed of the specific journal in which their medical photographs are to be published. In conclusion, non-identifiable rather than identifiable medical photography is acceptable to most patients in the studied Nigerian environment. The use of personal camera/personal camera-phone should be discouraged as its acceptance by respondents is very low. Judicious use of medical photography is therefore advocated to avoid breach of principle of privacy and confidentiality in medical practice. (shrink)

Individuálne a konkrétne procesy sú tak v podstate totožné s individuálnymi a konkrétnymi systémami, cez ktoré, v ktorých a prostredníctvom ktorých sa úplne realizujú, disponujúc tak vždy a všade vlastným substanciálnym obsahom. Na tomto základe potom vyčleňujeme slabo usmernené procesy (...) v neživej prírode s málo vyčlenenými alebo autonómnymi štruktúrnymi prvkami, stredne usmernené procesy živej prírody s oveľa väčšími, vyčlenenejšími a autonómnejšími štruktúrnymi prvkami vo forme živých buniek a postupne rastúcich a zdokonaľujúcich sa organizmov a tried organizmov a nakoniec silne usmernené procesy tzv. sociálnej prírody alebo ľudskej spoločnosti, pozostávajúcej z ľudí ako svojich základných alebo štruktúrnych prvkov a tiež z nimi generovaného technického a/lebo civilizačného "obalu", ktoré sú podobne ako živé procesy a systémy usmerňované a riadené čoraz väčším počtom pre nich špecifických vedeckých zákonov, princípov alebo "pravidiel". Catholic hospitals seek to offer health care in accord with the example of Christ. They have several models to assist in this effort. The first model is the values portrayed in the Gospels. The Catholic Church has sought to embody these Gospel values in specific teachings. These teachings have been further specified for hospitals in the United States by the National Conference of Catholic Bishops in the Ethical and Religious Directives. Finally, the Gospels values are also expressed for individual Catholic (...) health care systems in mission statements and statements of Catholic identity. This article examines the worth of mission and identity statements, and explains that the statements must be put into practice through a process of internalization before they will be able to be of worth to the Catholic health care apostolate. From the very first line of the magisterial work we are dealing with, Fr. Thomas Joseph White's 2022 The Trinity: On the Nature and Mystery of the One God, it is all about wisdom. Wisdom was already at the heart of a previous work by Fr. White devoted to the natural (...) theology of St. Thomas, his 2009 Wisdom in the Face of Modernity. Wisdom is more than the accumulation of information or the juxtaposition of knowledge. It is an eminent form of knowledge that, on the one hand, involves the person of the thinker in all its dimensions, intellectual, emotional, existential, and on the other, seeks to understand its object in the light of the most fundamental causes, which are simultaneously the most enlightening and explanatory principles because they are the most universal. The Trinity: On the Nature and Mystery of the One God is undoubtedly a work of wisdom. Fr. White grasps the entire Christian mystery from its Trinitarian source, since, as we shall see, the entire Mystery (in the Pauline sense of the economy of salvation in Jesus Christ as the fulfillment of the Father's benevolent purpose) is at the same time rooted in the eternal mystery of the triune God and makes it known to us as it unfolds its truth and saving power in time.But the sapiential nature of the object studied has some effect on the form of the work itself. Indeed, if Fr. White were not Rector Magnificent of the Angelicum, he would be a magnificent architect, because he possesses a sense of order to the highest degree and knows how to introduce unity in diversity. The presentation of The Trinity is perfectly structured, and therefore very [End Page 461] clear and didactic. Among many other factors that create its unity, I was especially interested in the highlighting of what the philosopher André de Muralt calls "structures of thought": similarities of proportionality between the ways in which authors from even very different theological epochs have treated a problem.1 I am thinking for instance of how Fr. White shows the strong structural similarities between contemporary Trinitarian theologies and the three types of medieval Trinitarian theology (the Franciscan, the Thomist, and the Nominalist). "My claim here is that the modern Trinitarian tradition tends to reproduce various elements of the medieval traditions, … albeit in creative and unexpected ways" (399). So it is a conceptually well-unified work, and where there is unity, there is being, goodness and beauty.The introduction, as I said, is placed under the sign of wisdom. Fr. White takes up there the neo-Scholastic theme of the "three wisdoms": philosophical wisdom, theological wisdom, and mystical wisdom.2 The book's perspective is explicitly that of theological wisdom, as a scientific form of the intelligence of faith, but (we shall return to this point in connection with the place given to philosophy) it puts into practice in an exemplary manner the collaboration, without confusion or separation, between the three wisdoms.3My purpose, of course, is not, nor can it be, to "summarize" the contents of a book of more than seven hundred pages, which manages to be both a comprehensive handbook for higher theological education and a true personal theological essay. I will therefore limit myself to highlighting three partial but significant aspects.(1) The first is the explicit and overt Thomistic character of the book (see 6–7). The paper deals with the topical issue of studying cyclic patterns in the economy and their practical application for the forecasts on the development of financial markets. The work aims to establish the features of the seasonal-cyclic patterns "The January barometer" and "The first five days of January" in the international financial markets in current conditions and to develop recommendations for the practical application of these patterns in the investment activities. The US stock market as an integral part of the (...) World financial market was chosen as a basis for research. The research was conducted by statistical processing of data on the values of the broad market index Standard & Poor's-500 for the period from 1950 to 2019. The study showed that the formation of forecasts about the annual growth or decline of the stock market index using the seasonal-cyclic patterns "The January barometer" and "The first five days of January" can show a high result in cases where the growth of the Standard & Poor's-500 index by the results of both the first five days of January and the results of the entire month of January of this year is a positive value. Otherwise, forecasting based on these instruments is not advisable. The best results (the forecast efficiency was 93.3%) were achieved with the joint application of both cyclic patterns. The practical application of the research results makes it possible to improve the efficiency of investment activities in international financial markets. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:A Báñezian Grounding for Counterfactuals of Creaturely Freedom:A Response to James Dominic Rooney, O.P.Taylor Patrick O'NeillIntroductionIn a recently published article, James Rooney, O.P., critiques a fundamental aspect of Réginald Garrigou-Lagrange's articulation of the relation between divine causality and creaturely freedom, which I also defended in my recent book.1 Specifically, Rooney argues that at least some of what Garrigou-Lagrange holds is rooted in a Molinist rather than Báñezian understanding of (...) human freedom and divine causality. The aim of this paper is to articulate the basic objections raised by Rooney and to show why the objections fail. We shall not provide an exegetical or textual analysis of Báñez himself, but rather will establish a speculative grounding and agreement between basic principles of Báñezianism and Garrigou-Lagrange's articulation, ultimately affirming the necessity of positing creaturely counterfactuals for Báñezianism.Rooney makes two distinct (but related) objections to Garrigou-Lagrange's treatment. First, he claims that Báñezianism as a system rejects the notion of "alternative possibilities" when considering the creaturely will and its relation to divine causality, especially in regard to physical premotion. I shall argue that this is incorrect, and indeed misses one of the constitutive elements of Báñezianism—in fact the very grounding for its claim that infallibly moved actions remain free. Second, Rooney claims that Garrigou-Lagrange posits [End Page 651] a circular argument regarding the reality of sin. Garrigou-Lagrange's argument would be circular if it corresponded to a single order of causality or if counterfactuals of creaturely freedom were incompatible with Báñezianism. But we shall argue that they are not. As such, the argument is not only not circular, but rather elucidates a constitutive element of the Báñezian system, thereby refuting the objection. In short, Garrigou-Lagrange's articulation of Báñezian premotion admits of counterfactuals without relying upon divine passivity, and it remains internally coherent.Rooney's Critique of the So-called "Garrigou Manoeuvre"Rooney begins the essay by outlining a few of the major differences between a Molinist and Báñezian view of human freedom. Rooney's argument is that there is a potential "grounding problem" for Báñezianism, or at least for Báñezianism as articulated by Garrigou-Lagrange. As Rooney notes, Báñezianism posits that God's efficacious grace is ontologically antecedent to our good actions (and his permission of sin is ontologically antecedent to our sin). But how does this position retain free choice, if divine causation or permission is infallibly determinative and antecedent to creaturely choice? Rooney says:The Banezians need to account for how it is possible that a creature can do otherwise in the special case when God moves the creature to act through grace. Specifically, what grounds the truth of the claim that, even when God determines human free choices from eternity such that a human being has only one course of action open to them, those human beings are morally responsible for their actions? If the Banezian view entails that human beings, acting under grace, strictly lack any ability to do otherwise, then the view is incoherent.2As such, we can see that "the ability to do otherwise" is an essential, grounding element for defending Báñezianism against radically compatibilist or double-predestinarian views of human freedom, which have been condemned by the Church at Trent and in subsequent condemnations of Jansenism.3 Of course, the phrase "ability to do otherwise" is metaphysically [End Page 652] ambiguous, which Rooney admits. Roch Kereszty long enjoyed thinking about how, and how much, we can discover the truth about Jesus of Nazareth through historical research into his earthly life. Fr. Roch also often enjoyed indicating that at least part of the answer is that research about a human being can never be content with descriptions of (...) any number of empirical facts or ideas from that person's life. The true goal of one who writes or reads about the life of another is insight into the meaning of that person's life. Such insight is possible some extent while the person's life is ongoing, but it calls for a more decisive kind of assessment after the person's death. The meaning of a life also cannot truly reveal itself when viewed through the lens of an inadequate philosophy or theology. Indeed, Fr. Roch tended to think that philosophy itself is adequate to show that any quest to understand another human being cries out to be structured by love, or at least some form of empathy: I can truly understand another only in my proportion to my ability to discover communion or affinity with that person, to find in him or her another self who is in some deep way similar to my own self.1 [End Page 781] Although Fr. Roch elaborated such ideas to guide historians seeking to write a "biography" of Jesus, and although they make great demands of many kinds, it nevertheless seems fitting to consider them when beginning to memorialize Fr. Roch himself.Last December, God granted Fr. Roch the gift of a passage from this life that was surrounded by the love of many people who had known him on earth. Among them were many who had known him through his theological writings and had found them to offer a special combination of intellectual vigor and personal relevance. It is a blessing now to be able to offer a short memorial for the benefit of his sympathetic readers of the past and the future. Attempting to explain the golden thread that unites his many books and articles seems unreasonable; the writings themselves remain their own best explanation. For both of these reasons, one good way to serve love and communion with a theologian of interest would be to portray him in some of the ways that he himself was loved, fathered forth and shaped, by the One from whom all fatherhood is named. In this essay, then, I offer a simple and very fragmented portrait of the sources of a theologian, the fontes theologi: the different ways that God fathered in Roch Kereszty a theological writer who was a blessing to people who read periodicals such as this one. Either God's giving efficacious grace to an individual (...) is such as to cause that individual to act a certain way, merely in virtue of giving that grace to that individual, or it is not. If that grace is not intrinsically efficacious, then you need to explain the way in which God can cause an action by giving grace which does not require grace to be intrinsically efficacious. On the latter front, Molinists aim to affirm that human beings are free even while acting under the influence of God's grace, and hold that God's grace is not such as to make it that one could not have done otherwise. They explain this by appeal to counterfactual truths about what human beings would do, metaphysically prior to and independent of God's subsequent decisions to give or withhold grace. These "counterfactuals of freedom" are central to Molinist accounts of freedom, since the truth of these counterfactuals alone secures the fact that human beings are acting freely even when God gives them grace and causes them to perform certain actions. Those human beings could have acted otherwise. Conversely, since God knows these truths, he can use them in order to give grace to an individual at those times when he knows it will be efficacious.To me, the Molinist view is a non-starter. What these truths consist in, what grounds them, how God uses them—I find the critiques compelling [End Page 675] and Molinist answers to these questions metaphysically problematic.1 I am committed to finding a Báñezian solution, therefore, to the riddle. From my perspective, the mystery of predestination invites confusion ultimately because the issue is a subtle philosophical, not a theological, problem. The resolution to the riddle of grace and free will can come only through an adequate account of the nature of human freedom. And I remain unsatisfied by a lack of philosophical clarity among Báñezian authors on the nature of freedom. In a recent paper, I therefore posed a problem for Báñezianism that resembles what is called the "grounding problem" for Molinism: where do the truths about alternative possibilities come from? And I illustrated the problem in the context of the account of grace given by one famous defender of the view, Fr. Réginald Garrigou-Lagrange, whose work in turn was recently promoted by Taylor Patrick O'Neill.In short, Garrigou-Lagrange appears to accept that there need to be alternative possibilities if human action is to be free. He gives an accounting of those possibilities as follows. On one side, when I sin, Garrigou-Lagrange argues that God's denial of efficacious grace, even though this denial occurs prior to anything I do or could have done, does not necessitate my sin because I performed the sin by means of my normally operating volitional and intellectual capacities (which God merely refrained from interfering in), and I had alternative possibilities provided by the possibility of God providing efficacious grace. Then, on the other, when I do good, he appeals at many points to non-culpable "defects" regarding my intellectual or volitional capacities as grounding those alternative possibilities that I could have sinned even when acting under efficacious grace. In both cases, my acts are still metaphysically contingent. However, neither case provides a sufficient grounding for alternative possibilities (I argued), because I had no relevant control over God's decision to deny efficacious grace, nor were those "defects" in light of which I could have sinned under my control. Instead, I argued that Garrigou-Lagrange's account of humans having alternative possibilities for action would be successful only if there were facts about what I would have done under sufficient grace, truths prior to and independent of God's decision to give efficacious... Inevitably a policy-oriented report on issues as complex and as rapidly changing as the medical and scientific uses of human tissue can achieve neither philosophical purity nor regulatory completeness. The council's strategy has been to begin with robust ethical principles, for which sound philosophical arguments can be given, which will (it is hoped) command widespread support. The council went on to argue for guidelines of sufficient, but not vapid, generality which could be of practical use to the various medical intermediaries, (...) professional and regulatory bodies and research ethics committees which will carry out the tasks of detailed regulation and of making decisions that affect uses of human tissue. The council's hope is that the recommendations of the report can be absorbed into regulatory and professional practice, and where needed into government policy. If they can, the increasing diversity of uses of human tissues need lead neither to overt nor to covert 'commercialisation of the human body', but will also not put unnecessary restrictions on advances in research and medical practice.
